Age Detective Terms of Use


1 Parties

Age Detective application (“Application”) are provided by Ardıç Ar-Ge Bilgi ve Teknoloji Çözümleri Anonim Şirketi (“ARDIC”).
Users understand that these Terms of Use (hereinafter, referred to as “Terms”) shall be effective as of their approval and that they are obliged to comply with the provisions set out in these Terms.
In these Terms, ARDIC and the Users shall separately be referred to as “Party” and as “Parties” collectively.


2 Subject of the Terms

The subject of these Terms is to determine the rights and obligations of the Parties with respect to the Users’ use of the Application and the Website which are being provided by ARDIC via Google Play and Apple Appstore.



3 Rights and Obligations of the Parties

3.1. The Application and Website are open to anyone on condition that they use the Application and Website in compliance with particularly these Terms, the terms set forth by ARDIC that are published on the Application and Website and with the relevant legislation. The User undertakes that he/she shall comply with these Terms and its annexes, other terms published on the Application and Website which are determined by ARDIC, and laws, ethics and manners and principle of honesty with respect to any of his/her activities to be carried out in the Application and Website.
3.2. The User shall be solely responsible for the use and management of any information that enables use of the Application and Website.
3.3. The User shall first download a special program (“Application”), which is provided via a web link such as Google Play to be notified to the User, to his/her mobile device (tablet, smartphone etc.) (“Device”) to use the Software in his/her Device.
3.4. The User accepts that he/she is aware that the security software he/she is using may interfere with the operation of the Software, and therefore the Software may not operate, and he/she may experience underperformance. The User is solely liable for inspecting whether the Device and other software and applications on the Device have features that may interfere or limit the use of the Software. The User agrees that ARDIC shall not be held liable, and he/she shall be solely responsible if he/she does not exercise such inspections or even though he/she does so, that the use of the Software interlocks the Device due to the features of the Device.
3.5. Rules with respect to the User information are set forth in the Privacy Policy. ARDIC shall not use the User information out of the scope stated in these Terms and the Privacy Policy and shall not disclose such information to third parties. In some cases, ARDIC may collect non-personal data which is specific to the Device via cookies. Such data is used for understanding the User better and enhancing the utility, performance and operation of the Application and Software. The User acknowledges that he/she permits the use of said data in such way.
3.6. The User shall bear any legal, administrative, or criminal responsibility that may arise from the use of the Application and Software. ARDIC shall not be held responsible, directly, or indirectly for any manner whatsoever, for the damages that may be incurred by third parties in consequence of the activities of the User carried out via the Application or Website, and/or of his/her breach of these Terms or law. Any claims to be submitted by third parties within this scope, and damages that may arise from the failure of the User to perform his/her obligations specified in the Terms shall be recourse to the User.



4 Intellectual Property Rights

4.1. All monetary, moral and commercial rights of ARDIC’s system, Website, and Application including but not limited to the images and designs, scripts, logos, graphics on the Website, and/or Application shall belong to ARDIC. ARDIC agrees to grant the non-exclusive and non-assignable right of use, on the part of the software offered via the Application to the User, and such limited right of use granted to the User shall not be interpreted against ARDIC.
4.2. The User shall only use the Application within the scope of these Terms. The User shall not lend such rights, provide for the use of third parties (individual, organization, corporation, company etc.) at cost like renting or at no cost, and make such right available to third parties. Within this framework, it shall be strictly prohibited to copy or reproduce the information, content and/or software used by ARDIC within the Application, use such information, content and/or software beyond the scope stated in these Terms and distribute, or process such information, content and/or software. The User shall also be strictly prohibited from carrying out activities that may threaten the security of the Application or Website ARDIC systems and/or cause damage to the Application, ARDIC and other users; make any attempts that may hamper the operation of the Application or Website and other software with respect to the Application or other Users’ use of the Application and Website, or put disproportionate load to the system or Application which may cause the aforementioned problems; gain unauthorized access to the information published on the Application or Website and/or inputted by other persons to the Application or Website, or to the source codes of the software or ARDIC’s systems; copy, remove, change said information or make any attempts to do so; use any software that may restrain the operation of the Application and/or Website, make any attempts to use such software or disrupt the operation of any kinds of software, hardware and servers, cause breakdown of such software, hardware and servers, reverse engineer, attack, keep occupied or interfere with such software, hardware and servers in any other manner; or endeavor to access the ARDIC servers. The User agrees that he/she shall not compete with ARDIC, the Application, in the abovementioned manners or by any other means, and that he/she shall not support third parties who intend to do so.
4.3. Any components of the Application or Website shall not be published in any media in any way including but not limited to written, oral and/or electronic ways, and/or links to such shall not be provided without ARDIC’s consent.


6 Limitation of Liability

6.1. The Application and Website are being offered “as is” by ARDIC, and ARDIC does not provide any claim or commitment with regard that the Application and Website are error-free, indefectible, and perfect, or fulfil the User’s personal needs.
6.2. ARDIC shall not be responsible foarise; accordingly, issue of the Application and Website by the User, the results and damages resulting from the User’s failure to fulfill his/her commitment and obligations; special, accidental or consequential damages which may arise out of such failure; the resulting economic damages; all kinds of profit loss, data loss, business loss, loss of reputation, loss of expected savings, loss of income and all kinds of material and non-pecuniary damages, third party claims for indemnification; (ii) all hardware, systems software/other software and network related function and defaults that might arise accordingly; (iii) defaults on the network, internet connection, design and connection; (iv) all kinds of changes, updates and similar actions that might be made by the User or third parties on the Application and Software; (v) damages arising from voltage fluctuation, electrical power cuts, virus attack, and similar environmental factors. The User agrees that in case of any interruption especially the internet cut off, he/she may not be able to use his/her Device in the usual way immediately, it may be required to restore the factory setting to use the Device in its usual way, and that in such case ARDIC shall not be liable for any loss or damages particularly the data loss.
6.3. TO THE EXTENT ALLOWED BY APPLICABLE LAW, ARDIC SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, WHICH MAY BE INCURRED AS A RESULT OF THE USE OF THE WEBSITE OR SOFTWARE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFIT, LOSS OF GOODWILL OR BUSINESS REPUTATION. FEATURES AND OTHER CONTENTS IN THE APPLICATION AND SOFTWARE ARE BEING OFFERED “AS IS” AND ARDIC DOES NOT PROVIDE ANY COMMITMENT OR UNDERTAKING WITH REGARD TO THE AUTHENTICITY, ACCURACY OR SECURITY OF SUCH. FURTHERMORE, ARDIC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OR USE OR NON-BREACH. IN ANY EVENT, ARDIC’S LIABILITY ARISING FROM THESE TERMS TOWARDS THE USERS SHALL BE LIMITED TO THE TOTAL AMOUNT OF THE INVOICE ISSUED IN THE EVENT THAT THE USER IS PURCHASED A GOOD OR SERVICE.
6.4. The User acknowledges and declares that links to the websites which are not controlled by ARDIC and/or platforms, files or contents may be given via the Application, third party services may be offered, and that such links shall not be considered as provided for purposes of support to the website or its operator, or as undertaking or guaranteeing anything with regard to the website or its content, ARDIC shall not be liable for the platforms, websites, files and contents, services or goods or their content.

7 Suspension and Termination of the Terms

7.1. ARDIC may suspend the User’s use and/or utilization of the Application temporarily or permanently if the User fails to comply with these Terms and its annexes, the User’s activities constitute legal, technical and especially information security risks, the User harms the third parties’ individual and commercial rights, or he/she breaches his/her obligations with respect to the Application.
7.2. ARDIC shall be entitled to suspend or terminate the Application and Website and/or these Terms at any time for a definite or indefinite period.


8 Dispute Resolution

With respect to the disputes that may arise regarding these Terms; provisions set out herein shall be applicable, with the laws of the Republic of Turkey to be applicable in the absence of any such provisions. The Courts and Execution Offices of Istanbul shall have jurisdiction in all disputes arising from the execution of these Terms.


9 Miscellaneous Provisions

9.1 In case of any force majeure event, ARDIC shall not be responsible for late or deficient performance of its activities specified in these Terms or failure to perform such activities. Including but not limited to acts of god, wars, mobilizations, fires, strikes, lockouts, problems arising from infrastructure, power cut and adverse weather conditions and similar reasons beyond the reasonable control of the Parties shall be interpreted as force majeure.Performances of the Parties shall be suspended throughout the period of the force majeure event. In the event that the force majeure lasts longer than 1 (one) month, the rights of this Agreement may be terminated by the party that cannot be performed.
9.2 The User shall not transfer these Terms of Use and/or the rights and obligations arising from the Terms of Use to third parties without the express written consent of ARDIC. ARDIC has the right to transfer these Terms of Use and the rights and obligations arising from the Terms of Use to third parties.
9.3 In case of disputes that may arise within the scope of these Terms of Use, ARDIC’s records (including records kept in electronic environment) will be accepted as evidence in accordance with Article 193 of the HMK (Law of Civil Procedure).
9.4 ARDIC shall be entitled to amend these Terms and the Privacy Policy which is an annex to these Terms, and other conditions published in the Application at any time unilaterally. The User shall be responsible for monitoring such documents on a regular basis.

Age Detective Privacy Policy


This Privacy Policy aims to determine the terms and conditions with respect to the use of the information and data of the Users. Privacy Policy is an annex to, and an integral part of the Terms of Use and capitalized expressions herein shall have the same meaning as defined in the Terms of Use.

This privacy policy governs your use of an application Age Detective (“Application”) on a mobile device that was created by ARDIC.

PermIssIons can be managed through your SettIngs menu on both AndroId and iOS devIces.

User Provided Information – The Application obtains the information you provide when you download and register the Application.

Transactions And Payments Data. If you use our payments services, or use our Services meant for purchases or other financial transactions, we process additional information about you, including payment account and transaction information. Payment account and transaction information includes information needed to complete the transaction.

Customer Support and Other Communications. When you contact us for customer support or otherwise communicate with us, you may provide us with information related to your use of our Services, including copies of your messages, any other information you deem helpful, and how to contact you (e.g., an email address). For example, you may send us an email with information relating to app performance or other issues.

Automatically Collected Information – In addition, the Application may collect certain information automatically, such as the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system.

Usage and Log Information. Application collects information about your activity on our services, like service-related, diagnostic, and performance information. This includes information about your activity, log files, and diagnostic, crash, and performance logs and reports.

Device And Connection Information. Age Detective collects device and connection-specific information when User install, access, or use our services. This includes information such as operating system information, app version, IP address.

Third Party Information

Third-Party Service Providers. We intend to work with third-party service providers to help us operate, provide, improve, understand, customize, support, and market our Services. For example, we work with them to distribute our apps; provide our technical and physical infrastructure, delivery, and other systems; provide engineering support, cybersecurity support, and operational support; process payments; help us understand how people use our services; market our services; help you connect with businesses using our services; conduct surveys and research for us; ensure safety, security and integrity; and help with customer service.

These companies may provide us with information about you in certain circumstances; for example, app stores may provide us with reports to help us diagnose and fix service issues.

ARDIC Share of Information


ARDIC shall not disclose the data submitted electronically by the Users via the Application or Website obtained by ARDIC during the use of the Application, to third parties, excepting its employees, subcontractors and affiliates who are required to know the information for the purposes and scope stated in Terms of Use and this Privacy Policy.

Such data may be used, other than the conditions stated in the Terms of Use, for the purposes of contacting with the User or enhancing User experience in the Application and Website (upgrading available services, creating new services, and providing customized services, etc.) as well as for the purposes of carrying out statistical evaluations, building databases and market research, without disclosing the User’s identity. Said data may be processed, retained, and transferred to third parties with the aim of direct marketing by ARDIC and its partners, as well as for sending notifications to the e-mail address registered in the Application or other contact information provided by the User, in relation to the promotion of ARDIC products and services.

ARDIC may also disclose the information concerning the User to third parties if:

• Such disclosure is obligatory to fulfill any obligations under the Terms of Use.

• A competent administrative or judicial authority requires information regarding the Users for the execution of a research or investigation in accordance with the applicable legislation.

• Providing information is necessary for the protection of Users’ rights or security.

ARDIC shall identify the IP addresses of Users and shall use these IP addresses where necessary, in order to define system-based problems and immediately resolve problems that may arise in the Application and Website. IP addresses may also be used for describing the Users generally, and for collecting comprehensive demographic information.

ARDIC shall be entitled to transfer the data, for the abovementioned purposes, to the servers (such servers may belong to ARDIC, its affiliations or subcontractors) anywhere in the world, rather than the User’s country of residence.

Providing links from the Website or Application to other websites or applications is possible and ARDIC shall not be responsible for the confidentiality practices and contents of such websites and applications.

ARDIC may revise the provisions of this Privacy Policy at its sole discretion. Revised provisions of the Privacy Policy shall become effective immediately upon their publication on the Website.

Assignment, Change of Control, and Transfer

If we are involved in a merger, acquisition, restructuring, bankruptcy, or sale of all or some of our assets, we will share your information with the successor entities or new owners in connection with the transaction in accordance with applicable data protection laws.

Managing and Retaining Your Information

We store information for as long as necessary for the purposes identified in this Privacy Policy, including to provide our Services or for other legitimate purposes, such as complying with legal obligations, enforcing, and preventing violations of our Terms, or protecting or defending our rights, property and users. The storage periods are determined on a case-by-case basis that depends on factors like the nature of the information, why it is collected and processed, relevant legal or operational retention needs, and legal obligations.
